We respect a person's (both ours and yours) ability to make mistakes - it leads to correction. (Savas Alus, 2009.)
We also respect your opportunity to motivatedly change your mind - perhaps the purchased thermometer is not comfortable enough and you want to change it to a different one. (See ibid).
And after putting everything in one place - call, let's talk, and we'll agree :)
We usually do not accept spilled hops back.
And below are the standard descriptions for you to familiarize yourself with user rights:
When buying goods and services online, you are protected by European Union legislation. As a resident/citizen of the European Union, you have the same rights in all EU countries, including the conditions for returning quality goods.
What do you need to know when buying online?
Consumer rights when shopping online include a wide range of rights that protect you as a buyer. Online shopping is a remote conclusion of a sales contract. This means that when concluding such a contract, the buyer does not have the opportunity to inspect the goods before buying and is completely dependent on the correctness and completeness of the information provided by the seller. This gives the buyer additional protections under European Union legislation. These buyer rights apply to purchases from sellers registered in the EU, Norway and Iceland. You can find detailed consumer rights when shopping online here: EU Directive 2011/83.
Consumer rights when returning purchased quality goods
The return of high-quality goods when buying online is possible within 14 calendar days, when there is no reason for the need to return due to the fault of the seller or the products (i.e. the product is of good quality). In English, it is called "cooling-off" or the right to withdraw from the contract, when the buyer can cancel the sales contract and return the goods to the seller. It is important to mention that the buyer's claim to return quality items is satisfied if the items have not been used, are undamaged, their usable properties have been preserved, the items have not lost their marketable appearance and the buyer has evidence confirming that he bought the items from a specific seller.
What items cannot be returned? Hotel reservations, car rental services, travel tickets and other leisure services, as well as personalized goods, audio and video content and products, perishable goods, lottery tickets and online games and gambling services are not subject to this right of withdrawal.
If the consumer uses the above-mentioned right to withdraw from the contract, the consumer's rights come into force - the refund must be made within 14 days. The refund amount for the services may be lower than the original price of the service.
A seller should always act in good faith, never make misleading statements or claims about their product, and never exert undue influence to induce a consumer to buy.
What is a cooling off period?
Every buyer has the right to a 14-day cooling-off period if you buy quality goods or services at a distance, for example:
Online (online store or online sales platform)
By phone
The sale is carried out in non-commercial premises (e.g. sales party, presentation, fair)
The right to withdraw from the contract starts from the day you physically receive the goods or from the conclusion of the service contract. In addition, you should generally be able to exercise your right of withdrawal before you physically purchase the goods (for example, if delivery takes time and you no longer want the goods by the time they reach you).
The seller must inform you about all aspects of the right of withdrawal, e.g. from which day the period starts and how you can return the product. The seller should also let you know how you can cancel the sales contract. If the seller fails to do so, the contract withdrawal period is extended to one year.
Here is the translation of the text into English:
What quality goods cannot be returned?
The 14-day right to cancel contracts for quality goods and services does not apply to everything. The list of non-returnable items:
- Airplane and train tickets, concert tickets, hotel bookings, car rental reservations, and catering services booked for specific dates (however, the possibility remains for the seller and buyer to agree on rescheduling the date that works for both parties);
- Goods and beverages delivered on a subscription basis, e.g., weekly grocery baskets, subscription-based cosmetics;
- Goods made to order or clearly personalized, such as custom-made suits, engraved jewelry;
- Sound and video recordings or computer software that are wrapped in transparent film for safe packaging, such as DVDs, which you must tear open the package to use;
- Online digital content – if you have started downloading or viewing it and agreed that by starting the preview, you waive the right to cancel the contract;
- Goods that were unwrapped after delivery and are unsuitable for return due to health or hygiene reasons (e.g., underwear, socks, swimsuits with removed hygiene labels, and others);
- Newspapers, magazines, and other periodicals after receipt;
- Goods purchased from a private individual, rather than a business or trader;
- Emergency repair and maintenance contracts – for example, if you call a plumber to repair a broken shower, you cannot cancel the service after agreeing on the price.
Please note that the above list is not exhaustive.
The cancellation period for quality goods ends 14 days after the day you receive them.
The cancellation period for service contracts ends 14 days from the day the contract is concluded.
If the cancellation period ends on a non-working day, your term is extended to the next working day.
How long can you return quality goods?
You can cancel a purchase agreement for quality goods or services within 14 calendar days from the day you receive them, without giving any reason. Defective goods are covered by a two-year legal warranty. For example, if you are interested in returning shoes, consumer rights can help if the product is faulty, even if more than 14 days have passed since the purchase. Not all goods or services can be returned – more details on this can be found in the section “What goods cannot be returned?”.
The seller may specify a longer return period.
What documents does the buyer need to provide to the seller to return a quality product?
To return a product purchased online, you must first inform the seller that you wish to cancel the agreement and return your purchase. You cannot simply send the item back, even if the 14-day period has not expired. The seller must provide you with a return form or a cancellation form for the purchase agreement, which you can fill out and inform them of your decision in writing. You are not required to use the provided form – you can express your decision in your own form. You can also send an email or fill out an online return form on the seller's website, if available.
You must send the goods back within 14 days of informing the seller, and the seller, in turn, must refund the money within 14 days of receiving your notification. The refund may be delayed if the seller has not received the goods or proof that the purchase has been returned.
The refunded amount should include the shipping costs you paid when purchasing the goods. Did you request non-standard delivery, such as expedited delivery or delivery services? In such cases, the seller may charge the delivery costs. When refunding the buyer the full amount paid, the seller will use the same payment method that the buyer used to pay the seller unless the buyer has expressly agreed to a different method, and provided that the buyer incurs no additional costs (i.e., if you paid for the purchase via bank account, the funds will be refunded to the same account).
Return costs for quality goods: Who covers them?
Return costs for quality goods are the responsibility of the consumer. It is important to note that some retailers offer free returns via mail, through a courier ordered by the seller, or by returning items to the store (e.g., online clothing and footwear stores). In the case of large items (e.g., large home appliances or furniture), the retailer must provide at least an approximate cost of return. However, if you purchased large items from non-commercial premises – for example, from a catalog or via a "door-to-door" delivery service – and the items were delivered directly to you, the retailer should always cover the return costs.
If non-standard delivery services were used during the purchase (for example, express delivery or delivery to the fifth floor), the seller may charge for these additional costs and not refund them.
Sincerely Your,
Savas alus
